Box, not so fast. Apparently in this thought/hate crime bill,sexual orientation is not defined when according to the APA the list of sexual orientations include pedophilia. Once the bill is signed into law these behaviors will all be classified within the protected class of sexual orientation. Thus, they did not want any amendment to clarify the definitions of sexual orientation or gender identity.

No, the current legislation does nothing whatsoever to create a system in any way analogous to the human-rights tribunals in Canada and England. I told you what the content of the legislation actually was; you paid no attention, since you seem to have no interest in the reality at all.

The legislation you pretended to be talking about does not have anything to do with creating punishments for anyone.
It is true that at the state (not federal) level there are often proposed hate-crimes legislation which permits motivations to be taken into account during sentencing. There is nothing new about this: we punish someone who injures or kills someone in a drunk-driving accident, but not the same as someone who injures or kills deliberately. Whether an offender is likely to be a continuing danger to society is an entirely legitimate concern during sentencing, and those who commit crimes of vandalism or violence with the intent of terrorizing a hated group are particularly likely to reoffend.

This is not the law. My sister was involved in defending Metzger, a notorious leader of Aryan Nation who was indicted for incitement to murder after a skinhead reacted to one of his speeches by going out and stomping someone to death; the precedent has been established that you need to actually ask for an act of violence before your speech can be prosecuted (of course, saying to someone "I'll give you $10,000 to kill my wife" is not protected as "free speech", never has been, never will be).

Considering the position that the U.S. is in and California in particular, you might want to add democracy and capitalism to you list of flawed ideologies that come with great consequence and suffering.
